Dienstleistungen als Schutzinstrument gegen Marken- und Produktpiraterie (Handling counterfeiting with services)

Abstract

Durch Marken- und Produktpiraterie entstehen grosse volks- und betriebswirtschaftliche Schaeden. Da die Moeglichkeiten des gewerblichen Rechtsschutzes zu deren Bekaempfung alleine nicht ausreichen, bestehen unternehmerische Schutzsysteme aus Buendeln an juristischen, betriebswirtschaftlichen, technischen und politischen Instrumenten bzw. Massnahmen. Eine systematische Analyse des Schutzpotenzials von Dienstleistungen wurde dabei bislang stark vernachlaessigt. In Anlehnung an den Resource-/Competence-based View untersucht dieser konzeptionelle Beitrag die Exploration und Exploitation von Dienstleistungen zum Schutz vor Faelschungen. Es wird analysiert, welches Schutzpotenzial sich ergibt und welche Determinanten zu dessen Nutzung relevant sind. Der Beitrag schliesst mit der Darstellung eines Anwendungskonzepts zur Ableitung konkreter Handlungsempfehlungen. (Counterfeiting and piracy result in large economic and corporate damage. Since industrial property rights alone are insufficient, corporate protection systems consist of bundles of legal, economic, technical and political instruments or measures. Here, a systematic analysis of the protective potential of services has so far been largely neglected. Following the Resource-/Competence-based view, this conceptual paper examines the exploration and exploitation of services to prevent counterfeiting. We analyze the arising protection potential and discuss the determinants which are relevant for its utilization. The paper concludes with the presentation of an application concept for the derivation of concrete recommendations for action.)
