Contractualiser l'ouverture des forêts privées au public ?

Abstract

[fre] La forêt reste la destination de loisirs privilégiée des Français. Face à la croissance de la demande, la loi d'orientation sur la forêt de 200 1 se tourne vers les forêts privées. Pour assurer la compatibilité de l'ouverture récréative avec les autres fonctions de la forêt, elle prévoit le versement aux forestiers d'une compensation pour services rendus. Après six ans d'existence de la loi, peu de conventions ont vu le jour car collectivités publiques et représentants des propriétaires disposent de peu d'éléments de référence pour définir les termes des conventions. Après avoir exposé le concept de consentement à recevoir comme fondement de la compensation dans le cadre des services récréatifs non marchands, cet article livre quelques indications sur les actions et les montants des contreparties financières à verser aux propriétaires. Il relève la disparité des attentes individuelles et l'ampleur relative du coût financier de l'application de la loi comparé au bénéfice non marchand de cette fonction sociale, estimé à 2 milliards d'euros par an. In order to face the increasing recreation demand, the latest forest law of 2001 turns to private forest owners to provide recreation activities. Then, it encourages the implementation of financial incentive schemes to better integrate the supply of recreation services with the other functions of the forest and woodlands, productive and non-productive ones. After six years of existence of the law, few conventions have been concluded since as public authorities as the representatives of landowners had little information at their disposal to launch negotiation on the contract terms. This paper emphasizes the uptake of agreements on free access recreational activities through the estimation of the landowner s willingness to accept for different constraints generated by the public recreational use. The results point out the disparity of individual valuations and the extent of the financial cost to pursue the application of the law in comparison with non-monetary benefit of forest recreation estimated at €2billions per year, at the national level.
