Abstract

[fre] La relation du droit et du fait contient à la fois la majeure partie des réflexions sur la théorie générale du droit et des critiques usuelles contre telle règle particulière, jugée excessive ou insuffisante. L'analyse empirique du droit rural français conduit à considérer la relation du droit au fait selon un rapport plus complexe, où la règle juridique n'est pas seulement un instrument de l'allocation ou de la répartition des richesses et ne doit donc pas être appréciée en fonction de son utilité ou de son efficacité. Le droit dans un pays fort peu juridique comme la France est la forme la plus solennelle du discours politique, destiné à donner au pouvoir l'occasion de renvoyer à la société une image vertueuse d'elle-même. Loin de permettre d'agir sur les faits, il les décrit avec des tabous et des mythes, exprime des représentations sociales ou des certitudes scientifiques et parvient à faire naître des faits plus qu'à les organiser par une norme. [eng] AGRICULTURAL LAW AND FACTS . This article focuses on the relations between Law and Facts. Instead of bringing a new theory of law or a new method to discover how to improve the efficiency of a particular statute or regulation from a social or an economical analysis, this article tries to explain the French legal system for agriculture as the most formal form of a political speech aimed at reflecting a honorable image of the French rural society. The real purpose is not to shape and frame agriculture but both to express with taboos and myths the traditional urban perceptions of this society and to transform the scientific standards into social schemes of behaviour.
