Abstract

[fre] Traditionnellement en France, l'eau souterraine appartient au propriétaire du sol, n'est conforme ni aux connaissances scientifiques, ni aux besoins de la société. Pourtant, aucune évaluation précise des avantages des diverses approches juridiques n'a été menée à son terme et le projet de loi, déposé en mai 1991 au Parlement, se contente d'une amélioration des moyens d'intervention dont dispose l'administration pour gérer au mieux les ressources en eau. [eng] The legal status of underground water. In France, underground water traditionnaly belongs to the owner of the ground, which is neither in keeping with scientific knowledge nor with the needs of society. Yet, no precise evaluation of the advantages of the various legal approaches has been completed and the bill, brought before the Parliament in may 1991, merely improve the means of intervention of the administration to manage the water resources as best as possible.
