La transmission de l'entreprise agricole : succession non préparée

Abstract

[fre] Le droit français, malgré une évolution provoquée d'ailleurs par les problèmes de l'agriculture, présente une certaine rigidité en matière successorale. La réserve héréditaire, l'égalité dans le partage, la prohibition des pactes sur succession future sont autant d'obstacles à la transmission de l'exploitation agricole. L'incessibilité du droit au bail rural, sauf entre ascendant et descendant, rend l'entreprise agricole juridiquement fragile. Au surplus, l'évolution de l'agriculture se traduit par un alourdissement considérable du capital investi qui n'est pas compensé par une amélioration de la rentabilité financière. Dans ce contexte difficile, l'entreprise agricole se transmet le plus souvent dans un cadre familial. L'opération suppose une préparation progressive et quelques précautions pour éviter des conflits entre les enfants et un coût fiscal insupportable. [eng] In spite of changes brought about by agricultural problems French law is strict as far as successions are concerned. The fact that heirs cannot be totaly disinherited, division into equal parts, the fact that agreements cannot be made concerning successions to come, are obstacles to the transfer of farm businesses. The impossibility of bequeathing lease rights except between parents and children increases the fragility of the businesses from a legal point of view. In addition, agricultural change has meant an enormous increase in the amount of capital invested without increasing its profitability. In such a context farm businesses stay within the family, which request some precautions to avoid conflicts between the children and excessive taxation.
