Abstract

[fre] L'utilisation de la planification spatiale, notamment pour préserver des zones agricoles en espaces péri-urbains rencontre bien des échecs. Il nous a semblé adéquat d'aborder ce problème sous l'angle de l'analyse économique des règles de droit. En matière foncière, offre, demande et prix sont étroitement dépendants des qualifications juridiques. Pour restaurer la neutralité économique des plans d'urbanisme, un double mécanisme serait nécessaire : récupération des plus- values, péréquation dans la distribution des droits à bâtir. [eng] Zoning to preserve farm land in suburban areas is difficult to implement. Economic analysis of legal rules seems a good approach because supply, demand and prices of land are deeply influenced by laws and regulations. Could land use regulations become neutral for land values ? This would require both fiscal mopping up of capital gains and use of pooling rules in the allocation of development rights.
