L’entreprise de moyens de paiement : quel acteur pour quel service au consommateur ?

Abstract

[eng] Payment services company : Which player for which customer service ? . The European Commission, in its consumer protection policy, stipulates that the payment system must be harmonized in the Community area. Beyond this harmonization organised through SEPA, the directive on payment services allows new players other than banks to enter the market, challenging in France some fundamentals of the law of 1984. Far beyond the sole usage of new technologies which is the main reason for existing of the new players, they should draw a new picture for financial services industry. The regulation authorities will have to control those new actors most of them coming from IT and supermarkets sectors. Finally, consumer protection and information will have to be carefully insured. In this new setting, the banks, and particularly the French, are facing many competitive and industrial challenges, which singularly put the sustainability of the current model for payment services at risk. . JEL classification : F36, G21, G28 [fre] La Commission européenne, dans sa politique de protection du consommateur, dispose que les moyens de paiement doivent être homogénéisés au niveau communautaire. Au-delà du SEPA qui réalise cette harmonisation, la directive sur les services de paiement autorise l’entrée sur ce marché d’autres acteurs que les établissements bancaires, remettant en cause en France, certains des fondements de la loi de 1984. Ces nouveaux entrants devraient modifier le paysage des services financiers, au-delà de la seule utilisation des nouvelles technologies, qui en est leur raison d’être. Les autorités de surveillance seront amenées à intégrer dans leur dispositif de contrôle ces nouveaux acteurs issus notamment des technologies de l’information et de la grande distribution. Enfin, la protection et l’information du consommateur devront être assurées avec vigilance. Mais ce sont bien les établissements bancaires, notamment français, qui se trouvent ainsi face à de nombreux enjeux concurrentiels et industriels, qui mettent singulièrement en cause la pérennité du modèle actuel pour les services de paiement. .
