Abstract

[fre] L’harmonisation européenne des règles de marché correspond à un besoin fort des acteurs. Des formes de normes existent également au niveau mondial et un certain nombre de forums internationaux prennent aujourd’hui une importance croissante. La mise en oeuvre dans les différents systèmes juridiques, réglementaires et prudentiels nationaux de « normes » édictées au niveau international, et la surveillance de leur application par les institutions financières sont en revanche toujours du ressort des autorités politiques nationales ou locales. Néanmoins, ce rôle déterminant pose la question de la légitimité et de la responsabilité des organismes internationaux producteurs de normes. La multiplication et l’internationalisation des sources de normes en matière bancaire et financière imposent également à l’industrie de restructurer l’organisation de sa représentation. La dimension transatlantique est enfin désormais un élément essentiel à prendre en compte. . There also exist international rules and some international forums have more and more influence today. The implementation of international rules in the different national legal, regulatory and prudential systems and the supervision of their application by financial institutions are still within the competence of national or local political authorities. However, this determining role raises the question of legitimacy and responsibility of these international authorities who produce rules. The internationalization and the increase in the number of rules’ sources in banking and financial area also impose on this industry to restructure its organization of representation. The transatlantic dimension has consequently to be taken into account. . JEL classification : F36, G21, G24, G28, K23
