Abstract

[fre] Il y a un écart grandissant entre la structure juridique des grandes institutions financières, et leur organisation opérationnelle. Pour cette raison, la supervision se concentre davantage au niveau consolidé du groupe. Cette supervision consolidée doit être cohérente avec la supervision au niveau de l’entité légale, pour laquelle d’autres superviseurs sont responsables dans le cas de groupes multinationaux. L’article décrit les problèmes pour trouver un bon équilibre entre tous les superviseurs concernés, et propose des mesures pour améliorer la situation en Europe. . There is a growing gap between the legal structure of big financial institutions and the way they are managed. Therefore, supervision focuses increasingly on the consolidated level of financial groups. However this consolidated supervision should be coherent with the supervision at the level of the legal entities, for which other supervisors are responsible in the case of cross border groups. The article describes the problems of finding the right balance between all the involved supervisors and proposes some measures to improve the situation within the EU. .
