Abstract

[eng] Evolution of european law on financial markets . This article deals with the legal questions brought on the european level by prudential regulation. European law has hardly evolved since 1993. Two difficulties arise : harmonisation of directives, and effects of internet business. . Classification JEL : G18, G20 [fre] Xavier Tessier aborde les questions juridiques posées par la régulation financière à l’échelle européenne. Celui-ci constate que le droit communautaire des marchés financiers n’a guère progressé depuis la directive sur les services d’investissement de 1993 et la réglementation financière communautaire demeure incomplète. Sa conclusion est qu’une réflexion de nature méthodologique est devenue souhaitable pour faire progresser la gouvernance de l’espace financier européen dans sa dimension juridique. Deux difficultés particulières doivent être surmontées : la question de l’harmonisation des transpositions des directives et celle des effets du commerce électronique. Il apparaît que la directive n’est pas le véhicule juridique approprié pour des harmonisations techniques et détaillées. . Classification JEL : G18, G20
