Abstract

[fre] Les accords de coopération interfirmes touchent un grand nombre de domaines de l'activité économique. Leur efficience potentielle est aujourd'hui expressément reconnue, comme en témoigne l'adoption par l'Union européenne, de cadres juridiques favorisant leurs conclusions. Affectant, par nature, le principe fondamental d'indépendance de comportement des entreprises, ces accords font toutefois l'objet d'une surveillance particulière des autorités communautaires, soucieuses d'en limiter les effets anti-concurrentiels. On trouvera dans cette contribution à l'analyse de la coopération inter-firmes, un exposé des principales dispositions juridiques en vigueur, ainsi qu'un examen critique des méthodes d'analyse encore très marquées, dans certains domaines, par les enseignements de la théorie néo-classique traditionnelle. [eng] Today numerous fields of the economic activity are concerned with cooperation agreements between firms. Their potential efficiency has now definitely been acknowledged, as testified by the adoption of legal frameworks favourable to their conclusions by the European Union. However, acting as a possible hinder to the assumption of the firms' independent behaviour, those agreements remain under the close watch of the EEC Commission eager to limit their anti-competitive effects. This contribution to the analysis of the cooperation between firms offers a survey of the main law regulations currently in force, as well as a review of methods of analysis which still bear in some fields the stamp of the traditional neo-classic theory.
