Abstract

[eng] The problem that we address in this paper stems from the trend to delegation in the water management field. The problem that we address refers to the municipality's negotiating disadvantage in the face of some cartelized water management. We discuss the specific characteristics of the delegation auction that render it useless as a tool for collective welfare maximization. We show that the remaining tool for achieving collective welfare maximization, i.e. the municipality's right to revoke delegation and return to direct management, is also ineffective due to a lack of credibility that is essentially financial in nature. Thus, if the credibility of revocation could be restored, the municipality's bargaining power could also be restored. Using standard methods of stochastic calculus, we model the municipality's right of revocation as a call option held by the municipality.We show that the value of this option depends to a large extent on the exercise price, which is partly determined by objective economic criteria and partly by legal and institutional conventions. Based on this we suggest that credibility could be restored by the constitution of a fund at least as large as the effective exercise price. [fre] L'objet de ce papier est de comprendre et de poser, en vue de leur résolution analytique, quelques uns des problèmes d'économie industrielle que la gestion de l'eau engendre. Nous montrons que cette question sectorielle au sein de l'économie de l'environnement admet des réponses qui peuvent être abordées avec la méthodologie de l'économie industrielle. Les problèmes d'analyse mêlent plusieurs niveaux qui tiennent à l'imbrication des centres de décisions et de gestion. Nous nous focaliserons sur l'étude des relations tripartites qui se nouent entre les élus, la population et les entreprises spécialisées dans les questions d'adduction et de traitement des eaux potables et usées. Les hausses spectaculaires du prix de l'eau potable, la revendication des populations pour une eau de bonne qualité, la difficulté dans certaines régions d'atteindre cet objectif, les changements de normes et la nécessité de modifier les caractéristiques des réseaux d'adduction constituent autant de facteurs qui nécessitent une réflexion approfondie. Les thèmes abordés concerneront la formation des prix et le changement des technologies, la nature de la relation d'agence entre le maire et sa municipalité en matière de délégation, et, enfin la nature de la relation contractuelle entre la municipalité et les entreprises délégataires. La question de la réversibilité potentielle de la délégation constituera le fil directeur de notre démarche.
