Abstract

: En ce qui concerne l'institution juridique de l'ordonnance sur requête, il est à noter qu'avec l'entrée en vigueur du nouveau code de procédure civile - l'intérêt pour la recherche et son approfondissement s'est accru, et pourrait répondre à son applicabilité dans de nombreuses situations juridiques. la réglementation n'a pas pu être résolue. Quant aux conditions de recevabilité de l'ordonnance sur requête, en tant qu'élément de nouveauté, nous parlons de la condition d'apparence de la loi, selon les dispositions légales en vigueur. L'analyse de la pratique judiciaire dans le domaine représente une opportunité pour faire une comparaison entre l'ancien et le nouveau règlement, en mettant en évidence non seulement les avantages, mais aussi une perspective critique des inconvénients offerts par le nouveau règlement.
