Sur Les Effets Juridiques Des Lois D’Approbation Ou De Rejet Des Ordonnances Du Gouvernement

Abstract

In our constitutional system, the government ordinances are issued under a legislative delegation, a delegation by law also called statutory delegation, from Parliament to Government, regarding ordinances through empowerment (those issued under certain enabling laws) or under a Constitutional delegation (emergency ordinances). The Government ordinances that need to be approved (only enabling ordinances with all the emergency ordinances), as a result of Parliament's approval become rules and regulations adopted by law, being absorbed by law and thus losing their own identity, while ordinances rejected by law, respectively those that are not subject to the approval of Parliament shall remain administrative acts.
