L’arbitraj, expresion de la justice privee par raport a la justice etatique

Abstract

Arbitrajul se considera a fi o institutie apartinând dreptului privat, mai bine spus o procedura speciala si derogatorie de la dreptul comun în materie, reprezentând o exceptie de la plenitudinea de competenta a instantelor judecatoresti. Institutia arbitrajului nu va duce la înlaturarea justitiei etatice, întrucât cele doua forme de justitie, completându-se reciproc, complinesc la realizarea aceluiasi rezultat, respectiv respectarea legii si garantarea ordinii de drept. Spre deosebire de alte sisteme de drept din Europa si Statele Unite, în tara noastra justitia privata pe calea arbitrajului nu a reusit sa cucereasca domenii de aplicare mai vaste, justitia etatica pastrându-si competenta de solutionare cu exclusivitate în anumite materii. Astfel, în aceste sisteme de drept s-a dat în competenta arbitrajului de a solutiona litigii sensibile privitoare la domeniul proprietatii intelectuale, litigii de munca, litigiile privind relatiile dintre parti la o societate comerciala si altele, ceea ce înseamna ca justitia privata în sistemul de drept român este înca în faza incipienta, cu toate ca aceasta a existat de la aparitia umanitatii. Concluzionând, afirmam ca arbitrajul poate fi considerat o adevarata justitie etatica cu caracter privat, arbitrul fiind la rândul sau un judecator privat, dar care nu dispune de „imperium”, adica de forta de constrângere a statului.
