The complaint against the acts and measures concerning criminal investigation of the prosecutor, addressed to the court. An analysis in the light of the present criminal procedure, constitutional and the European Convention of Human Rights’ provisions

Abstract

This paper approaches an interesting and actual aspect, relevant both from a theoretical and practical view: the possibility to file a complaint against the acts and measures concerning criminal investigation of the prosecutor. According to the present regulations the acts and measures of the prosecutor taken in the framework of a criminal case can form the object of a complaint filed by the interested person. Any person can file a complaint against the measures and acts of the criminal investigation if by these measures he suffered an injury in his legitimate interests. This analysis will relate to the criminal procedure rules, as well as to the provisions of the Romanian Constitution regarding free access to court and to the European Convention of Human Rights’ provisions on the right of any person to a fair trial by an independent and impartial tribunal that will determine if his civil rights have been broken
