    Abstract

    Malgré l’acception actuelle que la société moderne donne à l’enfance et aux droits de l’enfant et qui se caractérise par protection, amour, affection, l’histoire nous montre que les choses n’ont pas été toujours ainsi, l’enfance et le statut de l’enfant présente une évolution graduelle depuis l’antiquité jusqu’à présent, le soin accordé à l’enfant étant d’autant plus grande que la société s’est rendu compte de son importance et de sa placedans le cadre de la famille et de la société. Durant son évolution historique, l’enfance n’a pas été perçue comme une période distincte dans la vie de l’individu où il devait bénéficier de tous les droits spécifiques pour cet âge mais plutôt comme un tremplin vers l’âge mûr ; l’enfant a été vue comme une continuité de ses parents, sans être titulaire de droits et obligations distinctes qui consistent dans un ensemble de droits que les parents avaient sur l’enfant, qui arrive, petit à petit, de la qualité « d’enfant objet » à celle « d’enfant sujet » de droits et d’obligations.
