Aspects Regarding the Right to a Healthy Environment

Abstract

Dreptul omului la un mediu sanatos si echilibrat ecologic este un drept subiectiv atât universal, cât si individual. Atât la nivel mondial, cât si la nivel regional si national s-a prefigurat treptat necesitatea recunoasterii unui drept uman nou si fundamental, dreptul la un mediu sanatos si echilibrat ecologic. Realitatile economico-sociale si juridice actuale evidentiaza importanta majora a dreptului omului la un mediu înconjurator corespunzator, drept ce decurge din interesul comun al umanitatii, interes reflectat direct în drepturile recunoscute individului. Recunoasterea si garantarea dreptului fundamental al omului la un mediu sanatos reprezinta atât o premisa a existentei celorlalte drepturi fundamentale, cât si un factor determinant al îmbogatirii acestora si al aparitiei unor drepturi noi.
