The “material object”-“immediate effect” correlation as part of the indictment rule

Abstract

It is well known that in the area of criminal law, and not only, has indictment represented one of the most important concepts. It is not less important to correctly and wholly define this concept. For a better definition of indictment, doctrine introduces as distinct entities the legal object, the material object, the subjects involved, the time and the place, and consequently indictment becomes a complex concept, which comprises different constitutive groups that are hierarchically arranged. This paper approaches and highlights the “material object” and “immediate effect” correlation as part of the indictment rule.
