Abstract

Ce travail se propose de parler des aspects nouveaux qui sont de plus en plus présents dans la doctrine et dans la jurisprudence concernant la responsabilité de l’employeur pour le fait de l’employé. Ainsi, par rapport a la position manifestée par la doctrine juridique de l’Allemagne, de la Suede et de l’Autriche, qui fonde la responsabilité de l’employeur sur sa faute dans le choix et la surveillance exercée dans les fonctions confiées, dans la doctrine juridique française récente, est combattue la conception subjective, en apportant de nouveaux arguments pour le fondement objectif de cette forme de responsabilité pour le fait d’autrui
