Several considerations regarding arbitration court’s competence to statute its own competence

Abstract

One of the most important principle from international arbitration, the principle that admits the competence of the arbitrators to statute their own competence („Kompetenz – Kompetenz”) was overshadowed for a long time by another principle, equally important but better shaped, the principle of the arbitration convention autonomy, being considered as a corollary of the latter one.
