Abstract

Nous constatons que l'annulation du titre exécutoire ou des actes d'exécution a pour effet la nécessité de rétablir la situation antérieure, objectif qui se réalise soit dans la modalité prévue par la loi-l'article 404 du Code de procédure civile, soit de bon gré, soit par la voie du retour de l'exécution qui, dans cette situation, a le caractere d'une vraie action «de in rem verso». Dans ce contexte, nous considérons que le retour de l'exécution peut être vu du point de vue du droit matériel, comme une obligation de restitution qui fait part du contenu d'un rapport juridique d’obligation né a la suite d'un déséquilibre patrimonial par l'agrandissement d'un patrimoine au préjudice de l'autre, soit a travers le droit processuel, comme moyen procédural par l'intermédiaire duquel on peut rétablir l'ordre de droit violé, dans la situation ou cela ne se réalise pas par voie amiable.
