CJEU grapples with the intertwined nature of private copies and retransmission of online television broadcasts

Abstract

In Ocilion, the Court of Justice of the European Union ruled on two intricated aspects of the relationship between copyright law and Internet TV services, clarifying that de-duplication systems of copying of TV broadcasts do not fall within the scope of the private copying exception and that facilitating online retransmission does not amount to a communication to the public.
