Public Private Partnership in deutschen Kommunen

Abstract

Public Private Partnerships (PPP) sind in deutschen Kommunen flächendeckend verbreitet. Der vorliegende Beitrag zieht eine quantitative und qualitative empirische Zwischenbilanz dieser Kooperationen zwischen öffentlicher Hand und Privatwirtschaft. Die Ziele, welche von Wissenschaft und Politik mit PPP verbunden werden, werden in der Praxis selten erreicht. PPP befördern besseres Regierungshandeln und finanzielle Einsparmöglichkeiten kaum. Der öffentlichen Hand geht es in erster Linie um neue Finanzierungsmöglichkeiten für Infrastruktureinrichtungen jenseits ihrer Verschuldungsgrenzen sowie die Mobilisierung von privatem Know-how. Für den Erfolg von PPP bedarf es primär eines engen Vertrauensverhältnisses der Partner. Wie dieses aufgebaut werden kann, ist ungewiss. In naher Zukunft ist für dieses Problem keine Lösung zu erwarten, da die aktuelle Rechtsprechung des EuGH dem entgegensteht. PPP ist daher ein begrenztes und spezialisiertes Finanzierungsinstrument, dessen Chancen und Risiken nur der Einzelfallbetrachtung zugänglich sind.
