Flexicurity - Ein Konzept für das Arbeitsrecht der Zukunft?

Abstract

Mit ihrem Grünbuch "Ein modernes Arbeitsrecht für die Herausforderungen des 21. Jahrhunderts" hat nun auch die EU-Kommission das Konzept "Flexicurity" aufgegriffen, das in der Wissenschaft schon seit Längerem diskutiert wird. Bei Durchsicht der Kommissionsvorschläge stellt sich allerdings die Frage, ob dahinter mehr als eine verschleiernde Formulierung weitergehender Deregulierungsforderungen steht. Der Beitrag stellt ein Flexicurity-Konzept für Deutschland vor und setzt sich mit den Anforderungen auseinander, die sich daraus für eine konsequente Gesetzgebung ergeben würden. Anhand der Gesetzesreformen am Arbeitsmarkt der letzten 20 Jahre und der rechtspolitischen Debatte werden die aktuellen Chancen für die Verwirklichung eines solchen Konzepts überprüft - mit einem durchaus skeptischen Ergebnis.
