Abstract

Die Aufgabe des Rechts besteht nach Auffassung des Verfassers darin, eine Rahmenordnung zu entwickeln, die Orientierungs- und Planungssicherheit bietet und dabei Gerechtigkeitsvorstellungen der Gesellschaft zum Ausdruck bringt. Das Arbeitsrecht ist mit diesem Ziel schrittweise in der Praxis entwickelt worden. Diese naturwüchsige Praxisbezogenheit wird jetzt in dem rasanten und tief gehenden Strukturwandel des Arbeitslebens zum Problem. Das wird für die verschiedenen Bereiche arbeitsrechtlicher Gestaltungsformen erläutert; Reformansätze werden in diesem Zusammenhang kritisch gewürdigt.
