The Assumption of Law Neutrality: Property Rights Theory versus Legal-Economic Nexus

Abstract

Cet article s’interroge sur la signification réelle de la neutralité du droit supposée dans la théorie des droits de propriété, c’est-à-dire l’idée que l’allocation légale originelle des droits de propriété est sans importance en l’absence de coûts de transaction. Nous montrons que cela découle d’une interprétation de Coase (1960) et que cela fait partie d’un processus de désintrication du legal-economic nexus. Ensuite, l’article se penche sur ce que nous appelons la distinction entre le « qui » (domaine de la loi) et le « quoi » (domaine de l’économie). Cette distinction débouche sur une neutralisation du droit qui s’avère à la fois artificielle et insatisfaisante. Enfin, une reconnexion du « qui » et du « quoi » est proposée pour rétablir le sens et l’utilité véritables du legal-economic nexus. L’infiltration mafieuse dans l’économie légale est prise comme exemple.
