Algorithms, «Verifiability» of Automated Processing of Personal Data and Trade Secrets in the European Union

Abstract

Il contributo ha ad oggetto l’analisi del complesso contemperamento tra il diritto di accesso ai dati personali di cui al Regolamento Ue 2016/679 (Rgdp) e la tutela dei segreti commerciali predisposta dalla Direttiva Ue 2016/943. Il saggio definisce il raggio di trasparenza del trattamento di dati personali demandato dal Regolamento agli artt. 12-15; 58, comma 1, e 35 Rgdp per poi indagare la tenuta della disciplina del segreto commerciale predisposta dalla Direttiva Ue 2016/943 sulle informazioni relative agli input, agli output e alle funzionalità sistemiche degli algoritmi processanti. Sulla base di queste premesse, il saggio ripercorre le soluzioni di bilanciamento tra trasparenza e segreto dei trattamenti di dati offerte dalla giurisprudenza tedesca e italiana; nonché quelle suggerite dai considerando delle due discipline in esame. In conclusione, viene proposto un regime di tutela «modulata» del segreto relativo al trattamento automatizzato di dati personali.
