A Comparison of F/Rand licensing between Us, Eu and China: Towards a Private Ordering solution?

Abstract

Il lavoro esordisce con un'analisi comparata dell'evoluzione normativa di Stati Uniti, Repubblica Popolare Cinese ed Unione europea con riferimento agli impegni F/Rand inerenti la licenza dei c.d. Standard "Essential Patents". Preso atto della divergenza disciplinare che separa gli approcci dei diversi sistemi, viene valutata criticamente la capacità dello schema di giustizia procedurale individuato dalla "CGUE" nel caso "Huawei" di elaborare una soluzione normativa fondata sull'auto-regolamentazione privata. La giurisprudenza, in un simile contesto, è chiamata a svolgere un compito di mero e fisiologico controllo circa l'adeguatezza antitrust ed il rispetto del principio di non-discriminazione delle condotte delle "Standard Setting Organizations" e dei titolari di SEPS.
