The intellectual roots of «law and economics»

Abstract

Il contributo analizza criticamente le origini culturali del movimento di «law and economics». In tale prospettiva, vengono ricostruite le tappe e i motivi che hanno progressivamente condotto al consolidamento - pur complesso - dei rapporti tra scienza economica e giuridica, e fra economisti e giuristi. Nel discutere l'avvicinamento tra i due ambiti vengono passati in rassegna la nascita e l'evoluzione della disciplina antitrust nord-americana; il ruolo della Scuola di Chicago e il fondamentale contributo apportato da Ronald Coase. La trama complessiva riannoda dunque il Dna originario della metodologia e le ragioni della relativa utilità per ambedue le scienze sociali. Ne emerge un affresco chiaro, con un invito autorevole, che appare particolarmente utile oggi.
