The new regulation on broadband infrastructure: Towards simplification?

Abstract

Lo studio esamina due importanti provvedimenti adottati dal legislatore statale nel biennio 2008-2009 per rilanciare lo sviluppo della banda larga attraverso, il primo, la riduzione degli oneri amministrativi relativi all'installazione degli impianti e, il secondo, un nuovo programma di investimenti pubblici da realizzare secondo modalità che coinvolgano anche i privati. In una prospettiva diversa da quella generalmente seguita (incentrata, anziché sulla macroregolazione economica, sulla microregolazione normativa e amministrativa), lo studio intende, quindi, verificare se e, nel caso, come, le nuove disposizioni possano contribuire a superare la più volte denunciata eccessiva frammentazione ed onerosità normativa e amministrativa degli interventi. A un primo esame, i risultati - rileva l'autore - non sono completamente soddisfacenti. Essi tuttavia sono strettamente legati alla concreta applicazione delle disposizioni. Di qui, la necessità che l'istituzione meglio «attrezzata», l'AGCOM, assuma un'importante funzione di guida per orientare le amministrazioni pubbliche verso soluzioni più efficienti.
