    Abstract

    La psicologia cognitiva e l'economia comportamentale hanno evidenziato una serie di problemi in merito all'assunto delle scelte razionali degli agenti economici e della loro tendenza a massimizzare le utilità sulla base delle proprie preferenze. Tali risultati cominciano ad essere presi in considerazione dai giuristi con riferimento ai problemi cognitivi esibiti dai consumatori, nell'analisi di settori quali quello del diritto dei consumatori e della responsabilità del produttore. Scopo di questo articolo è di fare il punto sull'impatto degli studi in parola nella nuova area del diritto della concorrenza, nonché sui difetti cognitivi riferibili non tanto ai consumatori quanto agli amministratori delle imprese, cioè al lato della domanda, nonché ai giudici chiamati a regolare il mercato stesso sulla base delle norme giuridiche disponibili.
