    Abstract

    Il contributo analizza la tensione tra i due obiettivi della libera concorrenza inseriti nella Section 2 dello Sherman Act. In proposito, la disciplina sulla "monopolization" adottata negli Stati Uniti introietta anzitutto l'obiettivo di presidiare mercati da forme di dominio riconducibile al potere economico privato, conformemente al modello teorico della concorrenza perfetta. Allo stesso tempo, esprime un impegno ad avere mercati scevri dall'intervento governativo secondo il principio della illimitata libertà di contratto. In tale prospettiva, viene anzitutto passata in esame l'attuale interpretazione della monopolizzazione fatta propria dai giudizi della Corte Suprema e la relativa fiducia nei "self-correcting markets"; inoltre, dopo aver criticamente ricostruito i recenti casi Weyerhauser e Linkline, si sottolinea lo scetticismo verso una totalizzante fiducia nelle capacità redimenti dei mercati, concludendo con considerazioni circa il futuro della politica di monopolizzazione.
