Abstract

Nel momento in cui la Commissione europea ha ritenuto necessario intervenire per chiarire le modalità di applicazione dell'art. 82, ha dovuto fronteggiare numerosi problemi, tra i quali l'assenza nel Trattato di una definizione di "abuso" e la mancanza di una cospicua produzione giurisprudenziale in materia. Le Linee guida non risolvono tutti i problemi preesistenti e sollevano diverse perplessità riguardo all'impostazione di base e ai criteri di analisi prospettati.
