Public Services, Antitrust and the new Article 23-bis: in Search of a Thread

Abstract

La disciplina dei servizi pubblici in Italia è da tempo caratterizzata da una significativa instabilità normativa, in particolare per quanto riguarda le modalità di affidamento: l'art. 23-bis del decreto legge n. 112/2008 ha da ultimo previsto che gli enti locali intenzionati ad affidare "in house" i servizi pubblici debbano ottenere un parere favorevole (ancorché non vincolante) da parte di una serie di autorità, tra cui l'Autorità garante della concorrenza e del mercato. L'articolo ricostruisce brevemente il quadro normativo rilevante per procedere poi a una sua critica serrata. Seguono alcune considerazioni più generali in materia di antitrust e tutela della concorrenza, funzionali alla proposta di riconoscere una maggior libertà agli enti locali nelle modalità di affidamento dei servizi pubblici, cui viene ricollegata però una diretta responsabilità antitrust degli stessi enti locali per le condotte delle imprese "in house" controllate.
