The review of competition rules on vertical agreements in the motor vehicle sector

Abstract

Il 28 maggio del 2008, la Commissione europea ha pubblicato una relazione sull'impatto del Regolamento (Ce) n. 1400/2002, concernente l'esenzione per categoria delle intese verticali stipulate nel settore automobilistico. Dalle indagini della Commissione è emerso che il Regolamento (Ce) n. 1400/2002 potrebbe aver (i) imposto alle imprese contraenti vincoli non indispensabili alla promozione di una concorrenza effettiva, (ii) cagionato un incremento dei costi di distribuzione e (iii) ostacolato l'introduzione di modelli di distribuzione innovativi e l'accesso di nuovi operatori alle reti autorizzate. Alcune previsioni della disciplina di settore sembrano aver contribuito a migliorare le condizioni di concorrenza nel settore automobilistico, ma i medesimi risultati avrebbero potuto essere conseguiti mediante l'applicazione dei principi generali sanciti dagli articoli 81 e 82 del Trattato Ce e dal Regolamento (Ce) n. 2790/1999, sull'esenzione per categoria delle intese verticali. L'analisi della Commissione rivela un sostanziale fallimento della rigorosa e della dettagliata normativa settoriale, che sembra destinata a cedere il passo a un regime più flessibile, in linea coi principi su cui riposa il Regolamento (Ce) n. 2790/1999.
