A favore di un approccio economico nell'applicazione del diritto antitrust
Abstract
In questo scritto discutiamo le caratteristiche di un approccio economico all'applicazione delle norme antitrust in materia di pratiche unilaterali (art. 82). Riteniamo che, data la natura ambivalente di queste pratiche, una loro valutazione non possa che basarsi su una valutazione dei loro effetti pro e anticompetitivi, e che tale valutazione debba basarsi su una misura di benessere dei consumatori. Confrontiamo quindi l'approccio tradizionale concentrato sulla valutazione formale delle condotte e su una valutazione approssimativa della posizione dominante, e l'approccio economico, che richiede di esplicitare una spiegazione coerente basata sull'analisi economica e suffragata da elementi fattuali. Riteniamo che l'approccio tradizionale non differisca da quello economico per l'impostazione metodologica seguita, ma per l'implicito utilizzo di un'analisi economica rudimentale e arbitraria che non consente di identificare correttamente gli effetti, pro o anticompetitivi, delle condotte indagate. Una rilettura delle nuove proposizioni teoriche offerte dall'analisi economica si rende quindi necessaria per potersi tradurre in un insieme di procedure strutturate, gestibili e prevedibili dagli operatori.Download Info
