The New Antitrust Class Action?

Abstract

Questo contributo contiene una sintetica trattazione dell’applicazione della nuova azione di classe alle violazioni del diritto della concorrenza. Particolare attenzione viene dedicata al caso in cui siano state promosse più azioni di classe per una stessa violazione, alla verifica della sussistenza di tutti i presupposti per l’ammissibilità dell’azione (non manifesta infondatezza dell’azione, assenza di conflitti di interesse, omogeneità dei diritti, adeguatezza del ricorrente), alla raccolta delle adesioni e al finanziamento della lite. La trattazione è svolta anche mediante un confronto con la vecchia azione di classe. Si conclude con un giudizio complessivamente positivo della nuova disciplina, che è migliorativa rispetto al passato.
