The Quebec Civil Code and Its Influence on The Reform of the Romanian Civil Code

Abstract

The authors, qualified to practice law both in Romania and in Quebec, proceed to an examination of the evolution and the content of the Quebec Civil Code, given the present state of the legal reform in Romania. References are made to the civil nature of this province of Canada and to the influence of the French Civil Code in its legal system. The most important aspects of the history of the civil legislation are reviewed, over a period of 500 years. Also the specific conception of the Quebec Civil Code is highlighted and from this perspective the authors provide an account of the recognized civil institutions at this moment, mainly in order to point out the similarity with the Romanian civil institutions.The purpose of this article is to draw attention to the experience that the province of Quebec has had in the field of civil law, and to its possible positive impact on the Romanian legal reform.
