Infractiunea de fabricare sau de punere in circulatie a cardurilor sau altor carnete de plata falsa in legea penala a Republicii Moldova [The offense of manufacturing or circulation of false cards or other payment cards in criminal law of the Republic of Moldova]

The main goal of this article is to contribute decisively toward the scientific conception substantiation of the offence prevented in the art.237 PC RM. After the identification of the settlements, necessary to establish the most accurate way possible interpretation and practicability of the art.237 PC RM, the article proceed unto the proper examination of the manufacturing and the spreading of the cards or other forge payments card offence integrant elements. There are determined the entities formative of this offence material object (the manufacture) in order to specify those five stipulations, which are imperative for the entities to discharge cumulative. At the conclusion we find that the notion “the spreading of the cards or other forge payments card” contains other two constituent notions: 1) “the remission of the cards or other forge payments card”; 2) “the usage of the cards or other forge payments card”. Likewise, it is argued that the illegal taking of goods or the illegal consuming of some services or other kind of works, perfectly fits in the process of spreading of the cards or other forge payments card, therefore there is no need to put into additional characterization near the art.190 and the art.196 PC RM.
