Enforcement in Nature of Obligations. Comparative Aspects Between the Old and New Civil Code

Abstract

A contract requires the parties desire and willingness to acquire exactly what they deserve and exactly fulfill the obligations which they have assumed. When this goal is not achieved, the creditor has on hand various means including enforcement actions in nature. The object of this article will be to present the institution of enforcement in nature in the way it is described in the new Civil Code, highlighting the elements of difference compared to the old regulations.
