Abstract

Az Európai Közösségek Elsőfokú Bírósága 2007 januárjában a Bizottság egy olyan határozatát hagyta jóvá, amely nélkülözte a kiszorító/felfaló árazás jogszerűtlenségével kapcsolatos mélyreható közgazdasági elemzést, nem támaszkodott a jogsértőnek tartott magatartás várható piaci hatásainak vizsgálatára, és elmaradt az úgynevezett veszteség-ellensúlyozási próba (vagyis annak vizsgálata, hogy az esetlegesen sikeres kiszorító árazás utáni helyzetben az erőfölényben lévő vállalat megalapozottan számíthatott-e arra, hogy az elszenvedett veszteségei - a későbbi áremelés következtében - megtérülnek). Mi várható ezek után a közgazdasági elemzések jövőbeli szerepével kapcsolatban? Miért vállalnák a nemzeti versenyhatóságok vagy akár maga az Európai Bizottság a sokkal nagyobb kockázattal járó, illetve lényegesen nagyobb erőfeszítést igénylő közgazdasági elemzések bizonyítékként való alkalmazását, ha a jogsértés formális jogi alapon is könnyen bizonyíthatónak minősült? Várható-e visszalépés a hasonló ügyek vizsgálatában a hatáselvű bizonyítástól a formális alapú bizonyítás irányába? Journal of Economic Literature (JEL) kód: K21, L12, L41.
