Online mediation in resolving divorce matter: a literature review

Abstract

Online mediation was previously aimed to resolve online disputes. Nevertheless, it does not mean that online mediation could not resolve offline disputes, especially in cases that involve divorce matters. This article reviews the implementation of online mediation in resolving divorce matters in Maryland, Canada, and Netherlands. The purpose of the study is for Malaysia to learn from the experiences of the following states in utilising online mediation to resolve divorce matters. The methodologies used in this paper are doctrinal and comparative approaches. The finding of this research reveals that the adaptability of online mediation in resolving divorce matters in Malaysia. Thus, this paper is concluded by suggesting that online mediation is a possible alternative that can be used to resolve divorce disputes amicably.
