Retos actuales de la necesaria reforma de los incentivos fiscales al mecenazgo en España

Abstract

Este trabajo tiene por objeto realizar un análisis de los retos a los que se enfrenta el legislador español ante la necesaria (y eternamente pendiente) reforma de los incentivos fiscales al mecenazgo. Para ello, comenzaremos señalando la importancia de adaptar la normativa en vigor a las actuales formas de mecenazgo. Posteriormente, nos centraremos en la imprescindible modificación de la normativa estatal tras los diferentes pronunciamientos del Tribunal de Luxemburgo sobre la vulneración de la libre circulación de capitales por las regulaciones sobre los incentivos fiscales al mecenazgo aprobadas por diferentes Estados miembros. Para terminar, examinaremos las diferentes normativas autonómicas sobre esta cuestión y explicaremos los motivos por los que éstas pueden suponer una restricción a la libre circulación de capitales en la Unión Europea y al principio de igualdad en materia tributaria reconocido en la Constitución española.
