La Coordinación De La Fiscalidad Directa En La Unión Europea

Abstract

La coordinación en el ámbito de la fiscalidad directa tiene cada vez más importancia en la UE. El artículo analiza los tres ejercicios de coordinación que se han llevado a cabo hasta el momento, así como los motivos para optar por la coordinación y el papel que puede desempeñar esta en el futuro. El artículo estudia la coordinación en materia de imposición de salida, de compensación transfronteriza de pérdidas y de normas antiabuso, considerando tanto la jurisprudencia previa del TJCE que motivó el inicio del ejercicio, como las Comunicaciones de la Comisión europea y las actuaciones posteriores de coordinación por parte de los EEMM y sus resultados.
