Abstract

Die Buchanansche Vertragstheorie weist Schwachstellen auf, wie dies u.a. Stefan Voigt in dieser Zeitschrift (Bd. XI (2), S. 173ff.) aufdeckt. Unter Ber³cksichtigung solcher Kritik wird hier der Versuch unternommen, eine konsistentere vertragstheoretische Programmskizze zu entwerfen: Ausgehend von dem Buchanan/Tullockschen Interdepenzkostenkalk³l lõ▀t sich fragen, auf welche Institutionen sich vern³nftige Individuen einigen w³rden, wenn sie ihre zuk³nftige Position in der Gesellschaft nicht kennen w³rden. Dies ist der normative Teil des Programms, der aus einer unparteiischen Folgenabschõtzung denkbarer Institutionen besteht. Hieran schlie▀en sich die Fragen der Reformbed³rftigkeit eines betrachteten Status quo und der Durchsetzung der Reformen an. Bei dieser positiven Analyse ist es notwendig, bestehende gesellschaftliche Machtverhõltnisse in die Betrachtung einzubeziehen
