Саморегулируемые Организации В Сфере Финансового Рынка

Abstract

13 июля 2015 г. был принят Федеральный закон о саморегулируемых организациях в сфере финансового рынка1 (далее – ФЗ о СРО в сфере ФР), который вступает в силу с 11 января 2016 г. Несмотря на серьезную критику со стороны профессионального и научного сообще- ства на этапах разработки и рассмотрения Государственной Думой2, закон был принят почти без изменений. Таким образом, в России вы- страивается новая система регулирования деятельности СРО на финансовом рынке с активным участием Банка России, где степень такого участия во многом определяется самим регулятором финансовых рынков. Однако в ней есть несколько рискованных для независи- мости СРО моментов.
