La perequazione urbanistica "estesa": una anomalia nel panorama internazionale

Abstract

Questo lavoro propone alcune riflessioni critiche sul nuovo modello di perequazione "estesa" che ? stato recentemente proposto sia dalla riflessione tecnica che in alcune leggi ed esperienze locali. Lo sfondo di riferimento comparativo sono le caratteristiche tecniche e procedurali del Transfer of Development Rights americano dal quale ha tratto alimento la nostra perequazione urbanistica. Del tutto differente appare il caso di Milano dove, nel Piano di Governo del Territorio recentemente approvato, si conferma un modello di perequazione "estesa": la trasferibilit? dei diritti edificatori si applica infatti a tutto il tessuto consolidato della citt?, infrangendo l?implicito equilibrio dei valori fra area di origine e area di atterraggio. In estrema sintesi, la perequazione estesa potrebbe configurarsi come un cospicuo premio alla rendita e alla finanza immobiliare senza adeguati vantaggi per la citt? pubblica.
