Profili ricostruttivi della nuova disciplina dei contratti pubblici (D.Lgs. n. 36/2023)

Abstract

Il lavoro esprime alcune riflessioni sul nuovo codice dei contratti pubblici. Pre- messa una considerazione generale del sistema delle fonti instauratosi a seguito dell?entrata in vigore del d. lgs. n. 36 del 2003, il lavoro si sofferma sulle finalit? dell?atto quali desumibili dai principi generali posti da esso, anche in rapporto alla problematica della causa contrattuale, per soffermarsi poi su alcuni ambiti nei quali ? apparsa particolarmente significativa la novit? rispetto al codice previgente: ci si ? soffermati, in particolare, sul ruolo del RUP e della digitalizzazione. L?analisi si conclude con una disamina del possibile impatto della nuova disciplina nell?ambito del processo amministrativo.
