Tra divisione del lavoro e affinit?. La dialettica della solidariet? europea

Abstract

Il dibattito scientifico intorno al federalizing process europeo ha concentrato molta attenzione sulla possibilit? di uno sviluppo qualitativo nella direzione di una costituzione formale europea. Tale prospettiva, soprattutto dopo il fallimento del ?Trattato che adotta una Costituzione per l?Europa? e i contraccolpi politici della crisi finanziaria, ha messo in ombra l?originaria "via funzionalistica" e forse ne ha sottovalutato i risultati. Il saggio, muovendo dalla riflessione di L?on Duguit sulla solidariet? sociale, tenta di mostrare come il funzionalismo, radicandosi in una ?solidariet? di fatto?, abbia generato, pur all?interno di una dialettica incessante tra giustizia commutativa e giustizia distributiva, vincoli solidaristici pi? intensi di quanto hanno potuto fare i richiami alla dimensione etica della solidariet?. In questa prospettiva, la solidariet? di fatto non contraddice quella etica ma pu? esserne premessa. La conclusione ? una lettura meno pessimistica del processo di integrazione europeo; non tuttavia ingenua: alcune significative questioni tecniche inducono ad una costante prudenza.
